Terms of Service

Our terms, in plain English

These terms cover every Marine Layer Web website project and the optional Care Plan. When you pay your invoice, or reply "I agree" to the email that links here, you accept the version shown on this page at that time.

1. Who we are

Marine Layer Web ("we") is a small web design business owned and run by Kyle. "You" means the business that orders a website or Care Plan. Questions about these terms: kyle@marinelayerweb.com.

Your invoice shows your plan (Starter Site or Founding Client), whether you chose the Care Plan, and your domain.

2. Free preview

The preview of your new site costs nothing, and you are under no obligation to buy.

  • The preview is a draft shared at a private link. It stays Marine Layer Web's work until you pay; please don't publish or copy it before then.
  • You only pay if you decide to launch the site (section 4).
  • If you decide not to go ahead, we delete the preview on request and keep nothing you sent us.

3. What's included

The Starter Site and Founding Client plans include the same one-page website.

  • Invoices are due within 7 days. The site launches after payment clears.
  • Prices are in US dollars and don't include domain registration, which you pay directly.
  • Work beyond section 3 is quoted in writing before we start; nothing extra is billed without your OK.

5. Your part, timeline and revisions

We deliver your finished site within 3–5 business days of receiving your photos and information.

  • You provide: your logo (if you have one), photos you own or have permission to use, hours, services or menu, and contact details. You confirm everything you send is accurate and yours to use.
  • Timeline: the 3–5 business days start when we have everything we need, and pause while we wait for your answers.
  • Revisions: two rounds of changes are included. Further changes are quoted first, or covered by the Care Plan once you're live.

6. Launch, domain and hosting

Your domain stays registered in your name, and you can always move your site elsewhere.

  • Domain: you own and pay for your domain. If you don't have one, we help you register it in your own name.
  • With the Care Plan: we host your site and keep it running as part of the plan.
  • Without the Care Plan: we set your site up on free hosting in an account you own, or hand you the site files, your choice.
  • Launch day: we connect your domain, check the site on phone and desktop, and confirm it's live with you.

7. Care Plan ($39/month, optional)

The Care Plan keeps your site hosted and up to date for $39 a month, and you can cancel anytime.

  • Included each month: up to 3 small updates, such as new hours, a menu item, a photo swap or a line of text. Unused updates don't carry over.
  • Hosting: we host your site and keep it running.
  • Response time: we make requested updates within 2 business days.
  • Billing: a monthly Stripe subscription starting on launch day. You can update your card yourself through Stripe.
  • Cancel anytime: email us or cancel through Stripe. Cancellation takes effect at the end of the month you've paid for; partial months aren't refunded.
  • After cancelling: within 30 days we move your site to hosting you own or send you the site files, so it stays online.

8. Ownership and content

Once you've paid in full, the finished website is yours.

  • Your site: after full payment, you own the final design and site files made for you. Before payment, they remain Marine Layer Web's.
  • Your content: your logo, photos, text and brand stay yours. You give us permission to use them only to build, host and update your site.
  • Our tools: general code, layouts and techniques we reuse across projects stay ours; you get a permanent right to use them as part of your site.
  • Portfolio (Founding Client plan only): in exchange for the $349 price, you allow Marine Layer Web to show your site, your business name and a screenshot on our website and in our marketing. We never share private information. You can ask us to stop featuring it after 12 months.

9. Fixes, limits and ending the agreement

We fix anything that doesn't work as agreed for free during the first 30 days after launch.

  • Fixes: problems you report within 30 days of launch (broken links, layout issues, wrong details we entered) are fixed at no charge.
  • No guarantees on results: we build a good site, but can't promise search rankings, traffic or sales.
  • Outside services: we're not responsible for outages or changes at third-party services such as hosting providers, domain registrars or map services, though we'll help you work around them.
  • Limit of liability: our total responsibility under these terms is limited to the amount you paid us.
  • Ending before approval: either of us can stop at any time before you approve the site; nothing is owed.
  • Ending after launch: the one-time price isn't refundable once the site has launched. The Care Plan can be cancelled as in section 7.

10. General

  • California law applies.
  • These terms, together with your invoice, are the whole agreement between us. Any change must be in writing, and email counts.
  • We may update these terms for future projects. The version you accepted keeps applying to your project; for the Care Plan, we'll email you at least 30 days before any change takes effect.
  • We're an independent business, not your employee.
